Aim Games, LLC ("we," "our," or "us") develops, operates, and maintains skill based games available  for play on mobile devices (the “Apps”), including the App entitled “Cash-Out Club” and we also own and maintain the website aimgames.co, cashoutclub.app, and all related subdomains and features ((collectively, the “Website”). 

We are committed to protecting your privacy. This Privacy Policy explains how we collect, use,  disclose, share, and protect your information when you use our Website, our Apps, and any related  services (e.g., chat, forums, message boards, emails, surveys, virtual communities, and similar  services) (collectively, our "Services"). This Policy applies whenever you visit our Website, install, or  interact with our Apps, or otherwise access or use any of our Services. 

Our Services are available only in the United States, if you are outside of the United States, you are  not authorized to use our Services. This policy applies solely to users located in the United States. 

WE URGE YOU TO READ THIS POLICY AND MAKE SURE THAT YOU FULLY UNDERSTAND AND  AGREE TO IT. IF YOU DO NOT AGREE TO THIS POLICY, PLEASE DISCONTINUE AND AVOID  USING OUR SERVICES. 

1. Information We Collect 

We may collect the following types of information: 

(a) Personal Data you give us: You may give us personal data in a number of ways, including when  you register to use our Services, receive offers, communicate with customer service, enter contests, and accept prizes, and when you create an account. We collect this information. 

• Account Information: When you use certain Services, you may be required to register and  create and account (an “Account”). In connection with creation of an Account, you may be  required to choose a user name and password and provide some or all of the following  personal data:

• Social Networking Service Information. If we permit access to the Services through social networking services and you choose to log in, access or otherwise  connect to the Services through a social networking service (such as Facebook, X, YouTube, etc.), we may collect your user ID and/or username associated with that social  networking service, as well as any information you make public using that social networking  service or that the social networking service allows us to access. 

Some or all of the information above may be verified using a third party service provider, including but not limited to your age, identity and location. Please note that your username and photo/avatar will be visible to other users in the App. 

• Payment Information: When you make a purchase through our Services, our third party payment processor will collect billing information, such as credit card or bank account information and your billing address. This information will be held by the third party payment processor and subject to the payment processor’s privacy policy. We will not have access to your banking information, but we will retain data about your transaction history (payments, withdrawals, balance, etc.). 

• User Content: Any content you upload, share, or submit through the Services.

• Your Communications with Us: We, and our service providers, may collect the information you communicate to us, such as through email.

(b) Personal data we get from outside sources. We also collect personal data about you (such as  name, address, device IDs, location, internet service provider and usage and player information)  from third parties such as platforms, help desk vendors, fraud detection companies, analytics  companies, advertisers and related parties, payment processors, parties that verify geolocation and identity (including your precise geolocation, age and identity if you are depositing or withdrawing cash or playing cash matches), and other third parties).  

(c) Information We Automatically Collect 

• Your IP Address, Operating System, and Web Browser type/ version 

• Device Information: Details about the device you use to access the App, such as device  type, operating system, and unique device identifiers. 

• Usage Data: Information about how you interact with the App, such as features used, pages viewed, match history, skill level, and time spent. 

• Gameplay recordings: We collect and retain gameplay recordings. 

• Location Data: Certain features of our App are not available in some states. We collect information about your general location based on your IP address and will ask for your  specific location (which you will access and provide using your device settings) for use of  geo-restricted features. We may use a third party service to assist in determining and  validating your location.  

• Cookie Notice (and Other Technologies). We, as well as third parties, may use cookies, pixels, web beacons, and similar technologies (“Tracking Technologies”) to automatically collect personal information through your use of the Services.

o Cookies. Cookies are small text files stored in device browsers.

o Pixel Tags/Web Beacons. A pixel tag (also known as a web beacon) is a piece of code embedded in the Services that collects personal information about use of or engagement with the Services. The use of a pixel tag allows us to record, for example, that a user has visited a particular web page or clicked on a particular advertisement. We may also include web beacons in emails to understand whether messages have been opened, acted on, or forwarded.

(c) Information from Third Parties 

We may receive information about you from third parties, such as our payment and geolocation partners, when you  connect, verify and/or fund your account. If you connect your account or share content through a third party (like a social media platform), we may receive information about you through those third parties.

We use the information we collect for purposes including: 

• To Communicate with You: 

o To provide you with customer support; 

o To communicate with you about our products and Services, including promotions,  updates, offers or issues; 

o For marketing purposes, including offers, surveys, newsletters, notification of new  features, special events, and other notifications regarding the Services. Please note  that we may use Tracking Technologies (as defined below) (which may collect personal data) in order to  provide you with personalized offers or service suggestions when you visit our  Services; 

o For tutorials and other in game features (e.g., users may view gameplay recordings  to understand the results of a match and/or increase their skill); 

o To let you know about new developments in the Services; 

• To Manage and Improve our Services: 

o To provide access to Services; 

o To assess your skill level and match you with users of similar skill; 

o To provide and improve the functionality and user experience of the Services; 

o To enable you to enter into tournaments and other contests or competitions and/or  participate in other interactive features of our Services; 

o To personalize your user experience; 

o For internal operations including troubleshooting, data analysis, testing, research,  statistical and survey purposes, measuring effectiveness of certain features or  offers;  

o To otherwise assist us in maintaining and improving our Services and developing new Services, including but not limited to training or fine-tuning artificial intelligence tools or models;

o To manage and improve third party advertising. 

• Ensure Security of our Services and Comply with Legal Requirements 

o To ensure the security and integrity of the Services, including protecting against and  detecting fraud, abuse, and other unlawful activity; 

o Comply with legal obligations, including our age and location requirements; o Enforce our Terms of Services, other corporate polices and industry standards.

• Enforce Prohibitions against Cheating and other Fraudulent Activity. 

o It is important to us that our users have a fair and competitive experience in our  Services. We strictly enforce prohibitions against cheating, hacking, account  stealing, and any other unauthorized or fraudulent activity, which are described in  our Terms of Service. We use third party service providers and a variety of anti-cheat  and fraud prevention technologies to help us identify and prevent malicious activity.  These services may collect and analyze data about you, your game play, or other  data (which may include personal data) to detect cheating, and may be collected  and /or provided by us or by third party service providers. 

3. How We Share Your Information 

We may share, sell and disclose your personal information as described below: 

• Affiliated companies: We may share personal data internally with our affiliated companies and subsidiaries, for the purposes described in this Privacy Policy. 

• With Service Providers: We may share personal data with our service providers so that they can provide services to us. In addition, personal data and chat communications may be shared with service providers that help provide our chat features.These service providers include, but are not limited to: 

o customer service providers; 

o cloud storage services and hosting services; 

o payment processors; 

o analytics companies; 

o advertisers and marketing companies (including companies that assist in the  distribution or analysis of materials); 

o identity/ geolocation verification partners; and 

o Email, text and other communication partners. 

• Promotional Offers: We may share your information with third parties who sponsor or co brand certain contest, sweepstakes or other promotions. If you elect to participate in such  contests or promotions, we and the third party partner may collect and obtain personal  data you submit in connection with the promotion. Any third party’s use of this collected  data will be governed by the applicable third party’s privacy policy and terms of service. You  should read and understand these policies before submitting data in connection with any  applicable promotion. 

• Other Users You Share or Interact With. The Services may allow Aim Games users to share personal data or interact with other users of the Services.

• Third Party Advertisers: We may partner with third parties to manage advertising of our  Services. We may share your personal data with these advertisers so that they can provide services to us and these advertisers may use Tracking Technologies (that may  collect personal data) or collect other personal data about you. Any information collected may be shared with us. 

• Third Party Integrations: The Services allow, or may in the future allow, you to integrate  with certain third party services including our payment providers and social networking  services. If you elect to link to any of these third party services, your use of such services  will be bound by the terms and conditions and privacy policies of such service providers – please make sure that you read and understand these third party service providers privacy and other policies before you link to them through our Services.  

• For Legal Reasons: 

o We may disclose any data about you (including personal data) to government or law  enforcement officials, or private parties, in our sole discretion, as we believe is  necessary to respond to claims and legal procedures, to protect our or third party’s  property or rights, to protect safety, or to prevent or stop any other activity that we  believe violates our Terms of Service or otherwise poses a risk of being illegal,  unethical or otherwise legally actionable. We may be required to disclose personal data in order to comply with law or a lawful request from a governmental authority. 

o We may disclose any data about you (including personal data) to comply with legal  obligations, enforce our Terms of Service, or protect the rights and safety of users or  others. 

• Auditors and Advisors: We may disclose your data to external service providers, including  auditors, advisors and other professional service providers to assess and ensure our  compliance with legal and regulatory requirements and industry standards. 

• Mergers, Acquisitions and Similar Transactions: We may transfer, sell or otherwise share  your data in connection with a business transaction, such as a merger, acquisition,  reorganization, bankruptcy, or sale of some or all of our assets or other corporate change,  including in connection with the due diligence process for any such transaction. 

• For Statistical Analysis: We disclose non-identifying, aggregated user statistics to third  parties for a variety of purposes. 

• With Your Consent: When you explicitly agree to share your information with us or third parties. 

4. Your Rights and Choices 

You might have the following rights (and may have additional rights depending on the state  in which you reside): 

• Access, Correct and Update Information: You can review and update your account information  through the App settings (user name and avatar) or by reaching out to customer support  (other updates) at support@cashoutclub.com . 

• Opt-Out of Communications: You can unsubscribe from marketing emails by following the  instructions in the email. You may also opt out from receiving push notifications to your mobile device through our Apps. Please note that even if you unsubscribe from marketing emails or through our Apps, we  may continue to send you information regarding services and updates.

• Disable Location Tracking Services: You can disable location tracking through your device settings. Please note that if you disable location services, you will be unable to access certain functions and features of the Services that are limited or prohibited in certain states.

• Data Deletion: You can request the deletion of your account and associated data by  contacting us at support@cashoutclub.com or through the settings on our Apps. 

• Withdraw Your Consent to Our Processing of Your Personal Data. Please note that your withdrawal will take effect only for future processing and will not affect the lawfulness of processing before the withdrawal.

• California Privacy Rights. 

o If you are a California resident, California Civil Code Section 1798.83 permits you to  opt out of the disclosure of your personal data by us to third parties for third parties’  direct marketing purposes. To make a request to opt out of such disclosure, please  send an email entitled “California Resident Opt Out” to support@cashoutclub.com;  such email must include your full name and account username so that we can  appropriately effect the requested opt out. We may require you to verify your location and/or identity in connection with a California Resident Opt Out.

5. Tracking Technologies. 

When you use or access our Services, we use Tracking Technologies. Tracking Technologies allow us to automatically collect  information about you, your device, and your online behavior. We use Tracking Technologies to  enhance your experience on our website, including to improve our Services, perform analytics,  customize your experience, and oSer you tailored offers and promotions. 

Tracking Technologies embed small data files on your computer or device, which are used to collect  and share information. 

Types of Tracking Technologies We Use 

We use the following Tracking Technologies in our Services. 

(a) Essential or Strictly Necessary Tracking Technologies. These Tracking Technologies are  automatically placed on your device when you access our Services are take certain actions  in our Services. These Tracking Technologies are necessary for the Services to function and  cannot be switched off.  

(b) Performance Tracking Technologies. These Tracking Technologies collect information  about your online activity (for example, the duration of your visit to our Services and if you encounter error messages), including behavioral data and engagement metrics. This helps  us improve the website’s functionality and are used for analytics, research, and statistical analysis. 

(c) Functionality Tracking Technologies. These Tracking Technologies enable our Services to  provide enhanced functionality and personalization, such as remembering your language  preferences or the region you are in. These Tracking Technologies are used for authentication (to remember when you are logged-in) and support other features of our  Services. 

(d) Tracking and Advertising Tracking Technologies. These Tracking Technologies are used to  deliver content that is more relevant to you and your interests. They may also limit the  number of times you see an advertisement and help measure the effectiveness of advertising campaigns. The Tracking Technologies remember websites that you visit and  that information is shared with other third parties. Publishers, advertisers and third party ad  networks may utilize Tracking Technologies or similar technologies to deliver ads and  monitor the performance of ads. The collection of information through Tracking  Technologies by third parties will be governed by their own privacy policies/ cookie policies  and other policies that we do not control. 

Third-Party Tracking Technologies 

We may also allow third-party service providers to place Tracking Technologies on your device for  analytics and advertising purposes. These third parties include, but are not limited to, Twilio,  Appsflyer. AWS/Amazon redshift, Geocomply, Paypal, Paysafe, Google Analytics, Google Chrome, Microsoft  Edge, Mozilla Firefox, Safari, Android Browser and Facebook Pixel. Please note that we do not  control the use of these cookies and recommend reviewing the privacy policies of these third  parties. 

How We Use Tracking Technologies 

We use Tracking Technologies to: 

• Enhance your browsing experience. 

• Analyze website traffic and usage patterns.

• Provide personalized content and advertisements. 

• Remember your preferences and settings. 

Your Tracking Technology Choices 

You have the right to decide whether to accept or reject cookies and other Tracking Technologies.  You can manage your preferences through:

These settings or permissions are  not in our control and may change from time to time, so please review your iOS  settings and instructions and follow applicable instructions for your iOS version. 

o On Android devices, you may withdraw your consent in the Google Ads setting by  enabling the “Opt Out of Ads Personalization” settings. Instructions may vary based  on your device and we do not control these permissions or settings. You should  consult your device manufacturer and Google Ads for up to date instructions. 

• Opt-Out Links: For third-party cookies, you can opt-out by visiting the third-party’s website  or using tools like Network Advertising Initiative’s opt-out tool or Your Online Choices. 

6. How we protect your data 

We use industry-standard measures, including administrative, technical, and physical safeguards to help prevent unauthorized access, use or disclosure of your personal data. While we seek to  protect your information confidentially, no method of transmission or storage is completely secure,  and we cannot guarantee absolute security. You should be aware that there is always some risk  involved in transmitting data over the internet and there is also risk that someone could circumvent  our security systems. Such breaches can lead to disclosure of information and harm to you. We  encourage you to use discretion regarding the personal data you disclose. Please contact us at  support@cashoutclub.com if you feel that your privacy is not treated in accordance with this policy, or  if you believe a third party has attempted to access your personal data or otherwise acted  inappropriately in connection with our Services. 

7. Children’s Privacy 

Our Services are provided to a general audience and are not directed to or intended for children  under the age of 18. Users of our Services are asked to verify their age when they create an Account and you certify that you are 18 or older when you access or interact with our Services. We do not knowingly collect personal information from children under 18. If we obtain actual knowledge that  any information has been provided by an individual under the age of 18, we will promptly delete that  information.  

If you believe we have collected such information, please send an email to support@cashoutclub.com to request deletion of that information.

8. Retention 

We will retain your personal data for as long as necessary to comply with our legal obligations, to  provide our Services, to resolve disputes and enforce our policies. Retention periods will vary based  on legal requirements, including the type of information that is collected and retained.

We may update this Privacy Policy from time to time, at our discretion. Any changes will be  effective when we post the revised policy. Your continued use of the Services after such updates  signifies your acceptance of the changes. If we make material changes to this Privacy Policy that  increase our rights to use personal data that we have previously collected about you, where  required by law, we will notify you of such changes either through your registered email address or  by prominent posting in the App. Where permitted by law, your continued use of the Services after  such notification will constitute acceptance of the changes.
